1. The petitioner has preferred the present writ petition inter-alia with the following prayers:-
"I. Issue a writ order or direction in the nature of mandamus commanding the respondent no.1 State of U.P. through its Additional Chief Secretary Home UP at Lucknow to consider the application of the petitioner for extending fire arm license of pistol bearing license no. LN33031 A 7A16D19/519/lanka/BNS and Unique ID no. 330311001814022019 to carry all India license within stipulated time as may be fixed by the Hon'ble Court. II. Issue a writ order or direction in the nature of mandamus commanding the respondent no.3 Police Commissioner, Police Commissionarate Varanasi to consider for providing free armed Police Guard to the petitioner, within stipulated time as may be fixed by the Hon'ble Court."
2. After some arguments counsel for the petitioner confined his prayer only in respect of Prayer No. 1 and prayed that the Respondent No. 1 be directed to consider the application of the petitioner for extending fire arm license of the petitioner. Insofar as the prayer no. 2 is concerned, he prayed for liberty to file a fresh writ petition. 3. It is argued that in this regard application was submitted by the petitioner before the State-Government on 06.05.2024 and on the said representation the report was duly submitted by the Licensing Authority / District Magistrate, Varanasi to the Deputy Commissioner Police, Kashi Region, Varanasi on 14th July, 2025. It is further argued that though considerable time has already been lapsed but till date no decision has been taken in the matter, hence the present writ petition. 4. On the other hand, it is argued by the learned Standing Counsel appearing on behalf of State-respondent that the competent authority will take a decision in the matter, expeditiously. 5. Heard counsel for the parties. 6.
With the consent of the counsel for the parties and also in the interest of justice,
the present writ petition is disposed of finally, directing the Competent Authority of the State Government to look into the matter and take a final decision on the same strictly in accordance with law, most expeditiously and preferably within a period of two months from the date of presentation of certified copy of this order before him, unless there is no legal impediment.
