Heard the parties.
The petitioner has been made accused in connection with Baharagora P.S. Case No. 68 of 2023, corresponding to N.D.P.S. Case No.63 of 2024, for the offence registered under Sections 20/22 of the N.D.P.S. Act, pending in the court of learned District & Additional Sessions Judge-I, Ghatshila.
On 09.11.2023, Bahragora Police intercepted two vehicles bearing Registration Nos. JH 05AV-4968 and JH 05BD-8237 from a place near Jamshola bridge at NH-49. On search, about 51.170 kgs of cannabis were recovered from the vehicle bearing Registration No. JH 05AV-4968 and about 49.220 kgs of cannabis were recovered from the vehicle bearing Registration No. JH 05BD-
8237.
It was submitted that petitioner was neither apprehended at the spot nor anything was recovered from his possession. It was also submitted that none of the vehicles belong to the petitioner. It was finally submitted that similarly situated co-accused Ashok Kumar Das @ Ashok Das has been granted bail by this Court in B.A. No.125/2025.
Learned A.P.P on behalf of the State has opposed the prayer for bail but does not dispute the aforesaid fact.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned District & Additional Sessions Judge-I, Ghatshila, in connection with Baharagora P.S. Case No. 68 of 2023, corresponding to N.D.P.S. Case No.63 of 2024.
