No. 1409 of 2025 on the file of the fourth respondent, thereby the complaint lodged by the petitioner was closed and the petitioner was directed to approach the Court for appropriate relief. 2.The petitioner lodged complaint against the respondents 6 to 9 before the fourth respondent and on receipt of the same, the fourth respondent issued CSR to the petitioner in CSR No.231/2025 and after conducting detailed enquiry found that the entire allegations against the respondents 6 to 9 are civil in nature and directed the petitioner to approach the civil Court for appropriate relief. 3.The learned counsel for the petitioner submitted that the allegations attract the offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and therefore, the fourth respondent has no jurisdiction to enquire the complaint lodged by the petitioner and the complaint should be enquired only by the third respondent. 4.On a perusal of the records and the submissions made by the learned Counsel for Government of Tamil Nadu (Criminal Side) reveal that the complaint was lodged before the fourth respondent and the same was enquired by the fourth respondent for registration of FIR. Even for the offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, the https://www.mhc.tn.gov.in/judis WP Crl. No. 1409 of 2025 Inspector of Police has got jurisdiction to register FIR under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Only thereafter, investigation should be conducted by the officer not below the rank of Superintendent of Police. The fourth respondent found that the allegations against the respondents 6 to 9 are civil in nature and directed the petitioner to approach the appropriate Court.
