The petitioner has preferred the present petition inter alia with the prayer to quash the impugned order dated 10.07.2025 passed by respondent no. 2/Assistant Labour Commissioner, Kanpur Region Kanpur in Case No. 201/2015. 2. It is argued that it appears from the perusal of record that while filing First Appeal From Order No. 2755 of 2024 before this Court under section 13 of Employees Compensation Act, 1993 by the respondent no. 3, a sum of Rs. 8,62,140/- was deposited by him before the Court below. Since the interest on the aforesaid amount was not deposited a direction was given by this Court in the aforesaid appeal on 05.02.2025 to deposit the amount of interest. In the meanwhile an application was submitted by the petitioner before the respondent no. 2 on 18.06.2025 to make the payment of amount deposited by the respondent no. 3 during the pendency of the aforesaid first appeal from order, the same was rejected on 10th July, 2025 on the ground that during pendency of the aforesaid appeal the amount could not be released. 3. Heard counsel for the parties and perused the record. 4. In view of the facts and circumstances of the case, the present petition is disposed of without interfering the order dated 10.07.2025 passed by respondent no. 2, the petitioner is permitting to mover a proper application in pending First Appeal From Order, if so, advised.
