ORDER 26-03-2025 Heard Ms. A. Talukdar, learned counsel for the petitioner and Mr. B. Sarma, learned Additional Public Prosecutor, Assam for the State. 2. Apprehending his arrest, the petitioner, namely, Sri Mithun Roy, son of Sri Topan Roy, resident of village-Kokrajhar town, Ward No. 6, Police Station-Kokrajhar, District-Kokrajhar has filed this application on 24.02.2025 under Section 482 BNSS, 2023, praying for his pre-arrest bail in Kokrajhar Police Station Case No. 20/2025 registered under Sections 318(4)/ 351(1) BNS, 2023 corresponding to G.R. No.34/2025. 3. Matter relates to taking away the Car of the informant by the accused petitioner and did not handover the vehicle to him and kept in his Garage. 4. By order 27.02.2025, the Court while called for the case diary of said Kokrajhar P.S. Case No. 20/2025, granted interim pre-arrest bail to the petitioner in said Kokrajhar P.S. Case. 5. By order dated 18.03.2025, the Court directed the concerned Investigating Officer of said Kokrajhar P.S. Case No. 20/2025 to apprise the Court as to whether the petitioner appeared before him in said Kokrajhar P.S. case and as to whether as his statement has been recorded or not. 6. Today, on instruction, Mr. B. Sarma, learned Addl. PP submitted that pursuant to the interim order dated 27.02.2025 petitioner appeared before the concerned Investigating Officer of said Kokrajhar P.S. Case No. 20/2025 and his statement has already been recorded and that he is co-operating with the investigation of the case. 7. Considering such materials in the case diary, this Court is of the view that custodial detention of the petitioner, named above, is not warranted for investigation of said Kokrajhar P.S. Case No. 20/2025. As such, this pre-arrest bail application of the petitioner is accepted. 8.
Accordingly, the interim pre-arrest bail granted to the petitioner, namely, Sri Mithun
Page No.# 3/3 Roy, son of Sri Topan Roy on 27.02.2025 in said Kokrajhar P.S. Case No. 20/2025 corresponding to G.R. No. 34/2025, is hereby made absolute, subject to the compliance of the terms and conditions as specified in the order dated 27.02.2025. 9.
