Neutral Citation No. - 2025:AHC:133099-DB Court No. - 29 Case :- WRIT - C No. - 26124 of 2025 Petitioner :- Parvez Pasha Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Amar Singh Yadav,Dilnawaz Ahmad Khan Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J. 1. Heard learned counsel for the petitioner; Shri F.A. Ansari, learned Standing Counsel for State respondents and Shri Tejaswi Misra, learned counsel for Ghaziabad Development Authority (in short "GDA"). 2. The instant writ petition has been preferred for quashing the impugned notice dated 25.07.2025 issued by respondent no.3 and for a direction to respondent authorities not to demolish the shop in question pursuant to impugned notice. 3. At the very outset, learned counsel for GDA has raised preliminary objection regarding the maintainability of the writ petition on the ground that at present only notice has been issued and no final order has been passed. Instead of responding the said notice, the petitioner has straightaway approached this Court and as such the writ petition, being premature, is liable to be dismissed. 4. Considering the facts and circumstances of the case, without expressing any opinion on merits of the issue, the writ petition stands disposed of with observation that in case the petitioner files exhaustive objection to the impugned notice within two weeks, the same shall be considered and decided by the GDA strictly in accordance with law expeditiously.
