1. Heard Mr. U. Khan, learned counsel for the petitioners namely, (i) Bikram Neog, and (ii) Pranjit Saharia. 2. The petitioners have filed this application under Section 483 of the BNSS, 2023 with prayer for bail as they are behind bars since 20.01.2025 in connection with Mangaldai Police Station Case No. 14/2025 under Sections / 316(2)/318(4)/336(3)/340(2)/61(2)(b) of the BNS. 3. Heard Mr. R. R. Kaushik, learned Additional Public Prosecutor, Assam for the respondent State who has raised serious objection stating that there are incriminating materials in the case diary against the petitioners. 4. It is submitted on behalf of the petitioners that they have been languishing in the jail for 57 days and they are entitled to bail on the ground of parity as the co-accused have already been enlarged on bail. 5. The allegation against the petitioners is that they are members of a gang committing financial fraud under the shelter of KP Residency, Mangaldai. This gang has been hacking bank accounts of individuals and siphoning off money from bank accounts of several innocent persons. 6. I have scrutinized the Case Diary. Indeed there are incriminating materials in the Case Diary against the petitioners. 7. I have considered the submission that the petitioners are willing to cooperate with the remaining part of the investigation and the petitioners are
Page No.# 3/3 willing to abide by any stringent bail conditions if imposed upon them. 8. Considering all aspects, petition is allowed.
The petitioners shall be enlarged on bail on furnishing a bail bond of Rs.30,000/- each (Rupees Thirty Thousand) with a suitable surety of like amount to the satisfaction of the learned CJM, Mangaldai, under the conditions that: (i) The petitioners shall refrain from such activities with which they are alleged, (ii) The petitioners shall appear before the Investigating Officer every fortnight till completion of investigation, and (iii) The petitioners shall not leave the jurisdiction of the Court without prior permission. 9. On breach of any of the bail conditions, the Court is at liberty to cancel the bail granted to the petitioners. 10. In terms of the above observation, this bail application stands disposed of. 11.
