The report encloses series of documents particularly those of Kalna SD&SS Hospital, Kalna, Purba Bardhaman and the other documents including the medical certificate and cause of death of the deceased (Jharna Singha Roy). The grievance of the petitioner is that his mother expired under mysterious circumstances and the petitioner was not allowed to cremate her mother according to religious rites. A copy of the report along with the enclosures be handed over to the learned advocate for the petitioner. The enclosures to the report contained number of documents which may or may not satisfy the grievance of the petitioner. In case, the grievance of the petitioner relating to the cause of death of his mother still remains, the petitioner would approach the learned jurisdictional Magistrate under Section 175(3) of the BNSS. The learned Magistrate would conduct a preliminary enquiry, thereafter, take a decision as to whether to proceed or not to proceed in respect of the accusations. With the aforesaid observations, WPA 2299 of 2023 is disposed of. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
