JUSTICE M.I.ARUN ORAL ORDER The case of the petitioner is that he is the sole owner of the property which is the subject matter of the writ petition. It is further submitted that khata has been issued in his name by respondent no.2. However, it is submitted that while issuing the khata in the name of the petitioner, the name of one Sri.Lakshminarayana has been mentioned in the khata. It is submitted that the said Lakshminarayana is a stranger to the property, he is not connected to the property in any manner whatsoever and he does not have any right, title or interest - 3 - HC-KAR NC: 2025:KHC:34488 WP No. 16583 of 2024 regarding the property concerned. It is further submitted that petitioner is not aware of who the said Lakshminarayana is. Hence, the petitioner made a request to respondent no.2 to delete the name of the said Lakshminarayana and issue the khata only in the name of the petitioner. It is further submitted that respondent no.2 is also not in a position to state who the said Lakshminarayana is and because of which, the petitioner is not in a position to implead the said Lakshminarayana as a party to the proceedings. 2. For the aforementioned reasons, it is prayed that a direction be issued to respondent no.2 to delete the name of the said Lakshminarayana in the khata issued in respect of the property which is the subject matter of the petition and reissue the khata only in the name of the petitioner herein. 3. Learned counsel appearing for respondent no.2 upon instructions submits that, if the petitioner were to make a fresh application along with all the necessary particulars, they will consider the request of the petitioner in accordance with law and pass appropriate orders. - 4 - HC-KAR NC: 2025:KHC:34488 WP No. 16583 of 2024 4. Hence, the following: ORDER i) The petitioner is permitted to make a fresh representation to respondent no.2 regarding deletion of the name of Sri. Lakshminarayana and issue the khata only in the name of the petitioner in respect to the property which is the subject matter of the writ petition. (ii) Respondent no.2 shall consider the request of the petitioner in accordance with law and hear all the necessary parties and pass appropriate orders within a period of three months from the date of receipt of the representation. iii) The writ petition stands disposed of accordingly.
