G.A. 2 Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 01/08/2025 1 By way of this writ petition, the petitioner has sought direction to the respondent authorities to transfer his services from the Koriya to District Mahasamund as his wife namely Padmini Sahu is posted in the Office of Sub Health Center Koliha Devari, Block Basna, District Mahasamund after changing his cadre. 2 Brief facts of the case are that the petitioner was appointed as a Lecturer (Panchayat) by CEO, Zila Panchayat, Koriya, District Koriya. Later on, vide order dated 31.10.2020, services of the petitioner has been absorbed by the respondent No.2 in School Education Department in Teacher (L.B.) T-cadre. It is also pleaded that the petitioner’s wife, Smt. Padmani Sahu, is posted at the Sub Health Centre, Block Basna, District Mahasamund. On this ground, the petitioner seeks a direction for inter-departmental and inter-district transfer. 3 On the other hand, Mr. Raj Kumar Gupta, learned Additional Advocate General, appearing for the State would submit that no such direction can be issued by this Court, particularly in view of the policy of the State Government. 4 Taking into consideration the fact that the petitioner’s services were absorbed pursuant to a policy decision of the State Government, no mandamus can be issued by this Court directing the respondents to grant such transfer. 3 However, the petitioner is at liberty to approach the competent authorities of the State Government for redressal of his grievance. 5 With regard to the petitioner’s prayer for transfer from District Koriya to District Mahasamund, the issue falls within the jurisdiction & discretion of the administrative authorities, and hence no direction can be issued by this Court in this regard. 6 In view of the above, I do not find any good ground to entertain the present writ petition.
