1. This review petition is preferred on behalf of the review Petitioners under Order 47 CPC for review/recall of the order dated 28.01.2025 passed in W.P. (C) No. 1012/2025.

Mr. Abhijaat, learned Senior Counsel appearing for review Petitioners, at the outset, submits that along with the petition an application was filed under Order I Rule 10 CPC for impleadment of the applicants, as they were necessary parties in the writ petition but were not impleaded, however, the application is lying under objections and the order dated 28.01.2025 needs to be urgently modified in light of the direction passed by this Court. He submits that on oral prayer of the applicants, they be impleaded as parties to the writ petition.
3. On merits, grievance of the review Petitioners is that the writ petitioner did not deliberately bring to the notice of this Court that after the This is a digitally signed order. judgment was pronounced on 26.02.2024, by a subsequent order dated 18.03.2024 passed in CM APPL. 16786/2024, Court had clarified that observation in paragraph 34 of judgment dated 26.02.2024 was preliminary in nature and Court would take a final view once forensic audit report was received. The submission is that while seeking disposal of the representation dated 14.12.2024, Petitioner ought to have informed this Court of the order dated 18.03.2024.

Learned counsel for the Petitioner candidly and fairly submits that he has no objection to modification of the order dated 28.01.2025 to the extent that while deciding the representation, Respondent shall consider judgment dated 26.02.2024 along with order dated 18.03.2024.
5. In light of the consensus between the parties on this limited issue, paragraph 6 of order dated 28.01.2025 is modified and will read as follows:
“6. Since the Petitioner has made a representation to the Respondent on 14.12.2024, at this stage, this writ petition is disposed of, without entering into the merits of the case with a direction to the Respondent to decide the representation in accordance with law and in light of the judgment dated 26.02.2024 as also the observations in the order dated 18.03.2024. The decision shall be taken within a period of six weeks from today.”
6. It is further directed that before taking any decision on the representation dated 14.12.2024, representative of the Petitioner and review Petitioners shall be granted a personal hearing.
7. The representation shall be decided within a period of six weeks from today.
8. Review petition is disposed of in the aforesaid terms.
