CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER In this writ petition, the petitioner has challenged the summons dated 20.02.2023 (Annexure-A) issued by the respondent-authorities under the provisions of the Karnataka Protection of Interest of Depositors in Financial Establishments Act, 2004 (for short, 'KPIDFE Act, 2004') inter-alia sought for quashing the Intimation Letter dated 23.03.2023 issued by respondent No.3 (Annexure-B) and notice dated 17.0.2023 (Annexure-C) issued by respondent No.4 and to consider the representation dated 10.04.2023 (Annexure-D).
2. Heard the learned counsel appearing for the parties.
3. Upon considering the submissions made by the
learned counsel for the parties, it is noted that the summons dated 20.02.2023 (Annexure–A) has been issued by the competent authority for securing the petitioner’s attendance in proceedings under Section 3(1a) read with Section 6(2) (c) of the KPIDFE Act, 2004. It is also evident from the record that a police notice dated 17.01.2023, issued under the relevant

provisions, has been served on the petitioner requiring his presence.
4. Having regard to the nature of the allegations and the disputed questions of fact and law relating to the alleged financial irregularities in respect of the bank in question, this Court is of the opinion that no interference is called for at this stage in exercise of writ jurisdiction. Accordingly, the writ petition stands dismissed. All contentions of the parties are left open to be urged before the appropriate authority.
