CMM, BANGALORE DATED 02.03.2022 IN C.C.NO.10096/2019 BY ALLOWING THIS REVISION PETITION. THIS PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. 3 CONCILIATION ORDER Learned counsel appearing for the petitioner/s and the learned counsel appearing for the respondent/s are present. 2. Heard the learned counsel appearing for the respective parties. 3. Learned counsel for the petitioner/s on instruction from the petitioner/s-accused and the respondent/s along with his counsel have filed the joint memo, which reads as under: “The CRL.RP No.364/2024 filed against the order in CC.No.10096/2019 respectively dated 22.12.2023 on the file of the LXIII ADDL. City Civil & Sessions Judge, Bengaluru City dated 22.12.2023 have been settled between the parties on the following terms and the same may kingly be modified as under: The Petitioner and the Respondents respectfully submit as under:- 1. At the instances of well wishers and friends of the Petitioner and Respondents, the Petitioner and the Respondents above named wants to settle the matter amicable. 2. The respondents has presented the instant Complaint against the Petitioner Under Section 200 of Cr.P.CR/with 138 of NI Act for dishounour of Cheque amount of Rs.1,80,000/-. 3. The petitioner submit that the trial court convicted petitioner under section 138 of NI Act and sentence to pay total fine of Rs.2,00,000/-. The petitioner already depostiting 50% of the fine amount before the trial court the petitioner no objection released the said deposit amount to the respondent. 3. The Petitioner submit that It is agreed between petitioner and the Respondent that the Petitioner has agreed to pay a sum of Rs.1,00,000/- (Rupees One Lakh Only) to the respondent in full and final settlement and the respondent has agreed to received the same. 4. The Petitioner has further paid a sum of Rs.10,000/- (Rupees Ten Thousand Only) to the Respondent in the above case by way of Cash on 13/12/2025. The petitioner has agreed to pay the remaining amount of Rs.90,000/- (Rupees Ninety 4 Thousand Only) with in 1 months 25 days from this day on 1.2.2026 to the respondent, failing which the Respondent is at liberty to take legal action against the Petitioner. Wherefore, the petitioner and respondent above named parties respectfully prays that this Hon'ble Court be pleased to pass a judgment on the above terms and conditions in the above case. Hence the parties have compromised in terms of the above. The parties to this petition have set their hands to this settlement before the Lok Adalath in the presence Conciliators on this 13.12.2025 at Bengaluru Bench .” 4. In view of the joint memo, the petition stands disposed of and the petitioner-accused is acquitted for the offence punishable under Section 138 of Negotiable Instruments Act, 1881.
