The petitioner- Rahul Kumar @ Rahul Saw has been made accused in connection with Jaridih P.S. Case No. 20 of 2023 corresponding to G.R. No.122 of 2023 for the offence registered under Sections 302, 201, 34 of the I.P.C. pending in the Court of learned Additional Sessions Judge, Bermo at Tenughat. Earlier bail application of this petitioner was rejected and the same has now been renewed on the ground that out of ten witnesses, five witnesses have been examined and witnesses have not fully supported the prosecution case and have given contradictory version of the incident. The Petitioner is languishing in custody since 02.02.2023. Learned A.P.P. opposed the prayer for bail. This Court is of the view that examination of some of the witnesses is not a new ground for renewal of the bail application of the petitioner which has been earlier rejected on merit. I do not find any change of circumstance for renewal of bail application. Accordingly, the prayer for bail of the petitioner, is hereby, rejected again. (Gautam Kumar Choudhary, J.) Pawan/-
