Neutral Citation No. - 2025:AHC:131070 Court No. - 33 Case :- WRIT - C No. - 25806 of 2025 Petitioner :- Dimple Arora Respondent :- Union Of India And 5 Others Counsel for Petitioner :- Shiv Sagar Singh Counsel for Respondent :- A.S.G.I. Hon'ble Prakash Padia,J. 1. The notice dated 24.07.2025 issued by the respondent no.3- Estate Officer, Meerut Cantonment Board, Meerut under Section (2) of Section 5 of The Public Premises (Eviction of Unauthorised Occupants) Act, 1971 was issued to the petitioner and others on 14.05.2025. 2. It is argued by counsel for the petitioner that reply to the aforesaid notice was submitted by the petitioner and others and after considering the reply a letter dated 02.06.2025 was written by the Land Section, A.A.O., O/o Defence Estate Office, Meerut Circle, Meerut Cantt. Subsequent to the same, a letter dated 24.07.2025 was written by the respondent no.3 directing the petitioner to appear before him on 05.08.2025 at 12.00 hours personally or through counsel for hearing. Aggrieved against the aforesaid petitioner has preferred present writ petition. 3. On the other hand it is argued by Sri Sanjay Kumar Om, learned counsel for the respondents no.1 to 3 that the present writ petition is totally premature and no prejudice has been caused to the petitioner by the notice dated 24.07.2025 issued by the respondent no.3. 4. It is argued that only the petitioner and others were directed to appear in his office on 05.08.2025 and petitioner is free to raise all his objections as has been raised by him in the present writ petition. 5. In response to the same, it is very fairly argued that petitioner will appear before the respondent no.3 on the next date fixed in the matter and and he will raise all his objections as has been raised by him in the present writ petition. It is argued by counsel for the petitioner that today is the date fixed for hearing before the respondent no.3 hence respondent no.3 be directed to adjourn the matter at least for today and fixed some other date after ten days. 6. In this view of the matter, Sri Sanjay Kumar Om, learned counsel for the respondent is requested to apprise the authorities to adjourn the hearing today and list for hearing after ten days after giving prior notice to the petitioner. 7. In this view of the matter, present writ petition is disposed off finally permitting the petitioner to appear before the respondent no.3 on the next date fixed by him. 8. In case it is so, the respondent no.3 will go ahead with the matter as per law. Order Date :- 5.8.2025 Pramod Tripathi Digitally signed by :- PRAMOD TRIPATHI High Court of Judicature at Allahabad
