This writ petition has been filed with the following prayers:- "i) Issue a writ, order or direction in the nature of certiorari impugned order dated 17.04.2025, passed by Respondent No. 3 Sub Divisional Magistrate, Tehsil Mohammadabad, District Ghazipur to reconstruct the files of above said Appeals; ii) Issue a writ, order or direction in the nature of mandamus directing and commanding the Respondent No. 3 Sub Divisional Magistrate, Tehsil Mohammadabad, District Ghazipur to ensure the record of Appeal No. 139 of 1986 and thereafter decide the other connected Appeals No. 137/1986 138/1986 and 140/1986;" The first prayer made in the writ petition cannot be granted. However, in the second prayer, the appeals are pending consideration before respondent no.3. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.3-Sub Divisional Officer,Mohammadabad, District- Ghazipur to proceed with all the four appeals and decide the same strictly, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
