No. 1452 of 2025 __________ Page2 of 6 Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a WRIT OF MANDAMUS, or any other appropriate Wit, Order, or to Direct the 4th to 6th Respondents to immediately act upon the Petitioner’s Representation dated 13.09.2025 by including the 142 and few more beneficiaries of excess payments, as identified by the Petitioner’s company and to conduct a detailed verification of all the investor’s accounts and payment details, and their acquired properties, in connection with the investigation in FIR No.04/2024 in the file of EOW, Coimbatore and Consequently, directing the respondents to take all necessary steps for the attachment, seizure, and recovery of the said assets/funds from the 142 beneficiaries and few more to come, in accordance with the provisions of the TNPID Act and the BUDS Act, thereby ensuring maximal recover for the benefit of the depositors. The petitioner is an accused in Crime No.59 of 2023 registered for the offences under Sections 120B, 406, 420 and 506(ii) of IPC, Section 5 of Tamil Nadu Protection of Interest of Depositors (In Financial Establishment) Act, 1997 and Section 21(3) of The Banning of Unregulated Deposit Schemes Act, 2019. It is alleged that the petitioner received huge deposits from 56 members, amounting to approximately Rs.8 crores. Pending investigation, the petitioner submitted a representation stating that he had lent huge money from several persons. Therefore, the Investigating Agency shall ought to have taken appropriate steps to recover those amounts in order to pay the same to the victims. 4. On instructions, the learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondents submitted that the sixth respondent has already completed the investigation in Crime No.59 of 2023 and filed a final report before the Special Court under TNPID Act, Coimbatore, on 24.12.2025. The said final report is now pending for taking cognizance by the Trial Court. 5. It is seen from the records that, though the petitioner provided certain phone numbers and particulars of amounts allegedly lent to various persons, the investigation did not reveal any material to substantiate the petitioner's claim that such amounts had been advanced by him. No. 1452 of 2025 __________ Page4 of 6 investigation has already been completed and the final report has also been filed before the jurisdictional Court. 6. In view of the above, the relief sought for in this writ petition cannot be granted. Thus, the writ petition lacks merit and is liable to be dismissed. Accordingly, this Writ Petition (Criminal) stands dismissed. Consequently, connected miscellaneous petition is closed.
