Grant such other reliefs this Hon’ble Court deems fit, in the interest of justice and equity.” 2. This Coordinate Bench of this Court on 19.12.2024 had passed the following order: - 19 - NC: 2025:KHC-D:2874 WP No. 107340 of 2024 “Learned counsel for the petitioner in the aforementioned writ petitions, learned AGA for respondents No.1 to 3, learned counsel for respondent No.4 as well as learned counsel for respondent No.5 – Society present. In W.P.No.107340/2024, I.A.No.1/2024 is filed for impleading the applicant who was a contestant in the elections. Hence, it is just and proper that the said impleading application be allowed. Accordingly, I.A.No.1/2024 is allowed. The impleading applicant is permitted to come on record as respondent No.6 in the said writ petition. Learned counsel for the petitioner to amend the cause title and file amended cause title before the next date of hearing. Learn counsel for the 5th respondent - Society has filed the affidavit of the Chief Executive Officer of the Society wherein it is placed on record that the requisite stipulation under Rule 13-D(2-A)(ii) of the Karnataka Co-operative Societies Rules, 1960 has not been complied with. The said affidavit is taken on record. However, learned counsel for the Society placing reliance on para no.29 of the order of the Co-ordinate Bench of this Court in the case of Sri B. Ganganna and Others vs. The State of Karnataka, Department of Co- operation and Others , submits that although Rule 13-D (2-A) has not been complied with by the Society, the petitioners have not satisfied the requisite eligibility criteria as prescribed under Section 20(2)(a-iv) and (a-v) of the Karnataka Co-operative Societies Act. Learned counsel for respondents No.6 in W.P.No.107340/2024 has placed on record the endorsement issued by the Secretary of the Society that the petitioner has not carried out the minimum number of transactions. The said assertion is vehemently sought to be contended by the learned counsel of the petitioner and submits that on 18.06.2024 a remittance has been made in respect of a receipt has been issued by the Soceity. Learned counsel for the petitioner craves leave to produce material on record to evidence the same before the next date of hearing. - 20 - NC: 2025:KHC-D:2874 WP No. 107340 of 2024 To enable passing of further orders, the direction No.2 in the interim order to be complied with on the next date of hearing. In W.P.No.107563/2024 Learned counsel, Sri.Yash R Nadkarni undertakes to enter appearance on behalf of respondent No.5 and is permitted to file vakalath before the next date of hearing. Learned counsel for the petitioner is permitted to delete respondent No.6. Learned counsel, Sri.G.V.Bharamagoudar is requested to take notice for respondent No.4 also along with respondent No.2. Re-list on 08.01.2025.” 3. Learned counsel for the petitioner submits that the elections are now over and what would cover the issue now is the order passed by the Coordinate Bench in W.P.No.708/2024. 4. The Coordinate Bench has held as follows : “Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondent-State as well as the respondent-Society. 2. This Writ Petition is essentially filed seeking a Writ of Mandamus to include the names of the petitioners in the final eligible voters' list and permit the petitioners to vote and contest in the election to the Board of respondent No.4 - Society which was scheduled on 19.01.2024. 3. This Court by way of interim order permitted the petitioners to cast vote and permitted to file nomination - 21 - NC: 2025:KHC-D:2874 WP No. 107340 of 2024 paper to contest in the said election. However, the result of the election was withheld. 4. The learned counsel for the petitioners would contend that the mandatory requirements of Rule 13-D(2- A) of the Karnataka Co-operative Societies Rules, 1960 have not been followed while preparing the eligible and ineligible voters' list. Thus, it is urged that the petitioners should be treated as eligible voters' and their votes need to be counted as valid votes. 5. Learned counsel for the 4th respondent - Society would fairly submit that the Society has not followed the mandatory requirements of the aforementioned Rule. No specific objection is raised relating to the eligibility of the petitioners to contest in the election. 6. At this juncture, it is brought to the notice of this Court that in similar circumstances, this Court in the case of H S RAJU AND OTHERS vs STATE OF KARNATAKA AND OTHERS (2022(4) AKR 775) has permitted the votes to be counted and the election results to be announced keeping open all other contentions to be adjudicated in appropriate forum under Section 70(2) of the Karnataka Co-operative Societies Act, 1959. 7. It is relevant to note that merely because the petitioners were permitted to vote and contest in the election to the board of the respondent-Society, it does not mean that all the petitioners had the eligibility to vote and contest in the election. It is quite possible that all or some had the eligibility to vote and contest or may had incurred disqualification to vote and contest. Merely because procedures contemplated under Rule 13-D(2-A) of Karnataka Co-operative Societies Rules, 1960 are not followed, it does not mean that the disqualification if any incurred, is cured. Whether the petitioners did incur the disqualification to vote and contest or not, is a question of fact. Same is to be decided in a proceeding under Section 70(2)(c) of the Karnataka Cooperative Societies Act, 1959. 8. Hence, the following: ORDER (i) The Writ Petition is allowed-in-part. - 22 - NC: 2025:KHC-D:2874 WP No. 107340 of 2024 (ii) Returning Officer shall announce the results of the election to the Board of 4th respondent - Society held on 19.01.2024 by counting the votes of the petitioners. (iii) If any person entitled to raise a dispute under Section 70(2)(c) of the Karnataka Co- operative Societies Act, 1959, raises a dispute under the said provision questioning the eligibility of the petitioners to vote and contest in the election to the board of respondent-society, the said dispute shall be decided without being influenced by the interim order granted by this Court permitting the petitioners to vote and contest in the election to the board of respondent- society. It is made clear that this Court while granting interim order in favour of the petitioners, did not give any finding on the eligibility ofthe petitioners to vote and contest in the election to the board of the respondent-society. (iv) The question as to the eligibility of the petitioners to vote and contest in the election is kept open to be decided in a dispute if any, raised in this regard. (v) If any such dispute relating to the eligibility of the petitioners to vote and contest in the election to the board of respondent-Society is raised, the effect of holding the petitioners ineligible to vote and excluding such votes and excluding ineligible candidates on the final outcome of the election results shall also be taken into account before passing final orders. (vi) The ballot papers containing the votes cast by the petitioners shall be kept in a separate sealed box after counting. (vii) While counting the votes cast by the petitioners, a separate list shall be prepared disclosing the number of votes cast by the petitioners in favour of the candidates. Said list shall be separately maintained and be - 23 - NC: 2025:KHC-D:2874 WP No. 107340 of 2024 furnished to the authority, if summoned, while hearing election dispute in case such dispute is raised.” 5. The learned counsel for respondent-Society and the learned AGA for respondent-State in unison would submit that the matter could be disposed by recording the observation made by the Coordinate Bench in the aforequoted petition. 6. In that light, the following: ORDER (i) The Writ Petition is allowed-in-part. (ii) Returning Officer shall announce the results of the election to the Board of 5th respondent - Society held on 15.12.2024 by counting the votes of the petitioners. (iii) If any person entitled to raise a dispute under Section 70(2)(c) of the Karnataka Co-operative Societies Act, 1959, raises a dispute under the said provision questioning the eligibility of the petitioners to vote and contest in the election to the board of respondent-society, the said - 24 - NC: 2025:KHC-D:2874 WP No. 107340 of 2024 dispute shall be decided without being influenced by the interim order granted by this Court permitting the petitioners to vote and contest in the election to the board of respondent-society. It is made clear that this Court while granting interim order in favour of the petitioners, did not give any finding on the eligibility of the petitioners to vote and contest in the election to the board of the respondent-society.
