JUSTICE MOHAMMAD NAWAZ ORAL ORDER Learned counsel for petitioner submitted that petitioner was initially enlarged on bail on 26.08.2023 by the Sessions Court and since he failed to appear before the police in response to the notice issued under Section 41-A of Cr.P.C., he has been taken into custody and his bail application has been rejected. 2. Learned High Court Government Pleader contended that petitioner is involved in number of criminal cases and even after his release in the present case, he has been involved in 3 more criminal cases. Therefore, contended that if the petitioner is enlarged on bail, there is likelihood of indulging in criminal activities, as he is a rowdy-sheeter and he may also flee from justice. 3. Learned counsel for petitioner would submit that petitioner has been admitted to Sri. Jayadeva Institute of Cardiovascular Science and Research Hospital, - 3 - HC-KAR NC: 2025:KHC:37640 CRL.P No. 10298 of 2025 for Vascular Surgery Opinion and he is on medication. He therefore, submitted that petitioner may be permitted to file a fresh bail application before the Sessions Court on medical ground. 4. In light of the above submission, petition is dismissed as withdrawn, reserving liberty to the petitioner to file a fresh bail application before the Sessions Court on medical ground. 5. It is needless to say that the learned Sessions Judge shall secure the latest medical report pertaining to the petitioner and dispose of the bail application, if filed by him, as expeditiously as possible.
