2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.4724 OF 2025 ORDER:
The Writ Petition is filed to declare the action of the Respondent No.2 in not mutating the name of the Petitioner in municipal tax records relating to the houses bearing Door Nos. 9- 1-872, 9-1-873 situated in Plot No.27, admeasuring an extent of Ac.0.03 cents in Sy.No.1599 of Chennampalli Village, Badvel Mandal, YSR Kadapa District. 2. As per the case of the Petitioner, the property referred above was allotted to the Petitioner on 24.11.2022 by the Tahsildar. The Petitioner states that he had constructed three individual RCC and obtained individual Door numbers and tax assessments from the Respondent No.2. Out of three RCC houses, two houses bearing No. 9-1-872, 9-1-873 were rented to one Nukala Chalamaiah and B. Santaiah, who are none other than brother in laws of the Petitioner. As the municipal tax receipts were being shown the names of the above two persons, the Petitioner approached the Municipal Corporation i.e., the Respondent No.2 to make necessary corrections. As the Respondent No.2 was not taking any action thereon, again the Petitioner made representation to the Respondent No.2. The Respondent No.2 vide proceedings dated
3 03.08.2024 addressed a letter to the Tahsildar seeking clarification. The Tahsildar vide proceedings dated 08.10.2024 categorically stated that the said houses bearing D.Nos. 9-1-872, 9-1-873 are allotted to Petitioner as per the revenue records. 3. The learned Standing Counsel on instructions submits that notices were issued to the Nukala Chalamaiah and B. Santaiah, i.e., the brother in laws of the Petitioner and on whose names the tax receipts were issued regarding their ownership of the RCC houses in the property granted in favour of the Petitioner and consequent to the enquiry, appropriate reply will be given to the Petitioner. 4. Instructions placed on record. 5.
In view of the enquiry being conducted by the Respondent No.2 regarding claim of Nukala Chalamaiah and B. Santaiah over the suit schedule property, the Petitioner may also submit his explanation to the Respondent No.2. The Respondent No.2 shall consider and pass appropriate order thereon, as expeditiously as possible, preferably within a period of four (4) months. 4
