1. The present petition has been filed by the petitioner (now deceased) challenging the order dated 19.04.2017 passed by the District Magistrate, Mathura/respondent No.3 by which the firearm
license has been cancelled.Against the aforesaid order, statutory appeal has been filed which was also rejected by the Commissioner Agra Division Agra vide order dated 17.01.2018. 2. It is argued by learned counsel for the petitioner that both the orders were arbitrary, unjust & illegal only on the ground that only one criminal case being Case Crime No.931 of 2022 under Section 188 of I.P.C is pending and mere pendency of criminal case, the firearm license could not be cancelled and prays that both the order be set aside. It is argued that the trial of the aforesaid case is still pending and the petitioner who is accused had already been died on 04.08.2018 and there is no occasion to go ahead with the aforesaid criminal case. 3.Insofar as merits of the case, the Court is of the opinion that since the license had been cancelled only on the ground of pendency of the aforesaid criminal case and now the original petitioner namely Balo @ Bal Kishan had already been died no fruitful result would be found for continuance of the aforesaid criminal case.
4. In this view of the matter, the present petition is disposed of permitting the petitioner to apply afresh for grant of firearm licence before the concerned licensing authority. In case the petitioner does, the licensing authority will take decision in the matter strictly in accordance with law. 5. It is made clear that the aforesaid criminal case will not come in the way while taking the decision in the matter.
