Qureshi, learned Senior Counsel for the petitioner submits that the petitioner, at this stage, is not pressing for relief No. (a) which relates to directing the respondents, particularly the Deputy Commissioner Srinagar, to hand over the custody of the land measuring 32 Kanals 19 Marlas covered under Khasra No. 271/1, 273/1,938/270/271/2,663/273/2 and 705/721/2 situated at Brien Nishat Srinagar, back to the petitioner, in strict conformity with the J&K Migrant Immovable Property(Preservation, Protection and Restraint On District Sales) Act, 1997, as being legal heir of migrant deceased S. Aatma Singh, recorded tenant of the land. learned Senior Counsel, however, submits that the present petition be disposed of by directing the respondent No. 2 to take a decision pursuant to the notice dated 24th of May, 2024 within some stipulated period of time. 2. Notice. 3. Notice waived by Mr. Jahangir Ahmad Dar, on behalf of the respondents. He submits that in view of the innocuous submission made by learned Senior Counsel for the petitioner the present petition be disposed of, accordingly. 4. In view of above, the present petition is disposed of by directing the respondent No. 2 to take a call qua the notice dated 24th of May, 2024 served upon the respondent No. 2 through counsel projecting the grievances of the petitioner and for their redressal thereof. The respondent No. 2 shall proceed in accordance with law within a period of three months from the date of receipt of certified copy of this order along with the notice dated 24th of May, 2024. 5.
