This petition, purportedly in public interest, has been filed by the petitioner seeking a direction to respondent nos. 2 and 3 to construct the public pathway (Khadanja) and recover the government dues from respondent nos. 6, 7 and 8. 3. Submissions have been made that the pathway in question has been damaged by respondent nos. 6 to 8 and, therefore, the same be repaired and the amount thereof be recovered from respondent nos. 6 to 8. 4. A perusal of the record indicates that a suit filed by respondent nos. 6 to 8 is pending consideration before the court of Civil Judge (Junior Division), Havali, Varanasi, to which uncle of the petitioner is one of the defendants, wherein the temporary injunction application filed by the said respondents has been dismissed and in the appeal filed against the said order, there is no interim order. 5. As the dispute pertaining to the land in question is pending consideration before the Civil Court, passing of any order by this Court would affect the outcome of the pending suit and, therefore, we do not find any reason to entertain the present petition, the same is, therefore, dismissed.
