(Oral) Having taken note of the fact that petitioner, who at present is working as Assistant Engineer in the department of Jal Shakti Vibhag, has completed two years at present place of posting, this Court is not inclined to entertain the present petition.
2. However, having taken note of the fact that petitioner’s wife is also a Government employee and there is provision in the Transfer Policy to post couple at one station or convenient places, this Court, without going into the merits of the case, deems it fit to dispose of the present petition reserving liberty to the petitioner to file representation before the competent authority within a period of one week for redressal of his grievances as have been raised in the instant petition, which in turn, shall be decided by the competent authority
expeditiously within a period of one week. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate order taking note of provision contained in the Transfer Policy with regard to adjustment of couple. Till the time representation, if any, filed by the petitioner is decided by the competent authority, he shall not be compelled to join at the transferred station, if not already relieved.
