Sri Abhishek Singh, Advocate has put in appearance on behalf of respondent no.4. 3. By means of the present writ petition the petitioner is praying to quash the impugned First Information Report dated 22.6.2023, registered as Case Crime No. 0148 of 2023, under Sections 313, 354, 354Kha, 376, 504, 506, 120B, 328, 201, 34 IPC and Section 67 IT Act and Section 3/4 Muslim Women (Protection of Rights on Marriage) Act 2019, P.S. Shahganj,District Jaunpur. 4. When the writ petition for quashing of the FIR was filed before this Court, the Court vide its order dated 13.8.2024 had referred the matter to the Mediation & Conciliation Centre of the Allahabad High Court, wherein on 20.12.2024 settlement/agreement was entered into between the petitioners and respondent no.3. The agreement was entered as is contained in paragraph no.7 of the settlement/agreement dated 20.12.2024, wherein, it has been stated that all cases civil & criminal filed by the parties against each other would be withdrawn by the parties. The paragraph no.7 of the settlement/agreement dated 20.12.2024 of the Mediation & Conciliation Centre, High Court Allahabad is reproduced hereunder:- "क. यह कक कदनननक 22.11.2024 कक हहए अनतररम समझझतत कत आधनर पर पककनर पपरर सझहनदर एवन सनतह पपवरक पकत- पतनन कत रप मम रहतत हहए आज मधयसथ कत समक उपससथत हह और कथन करतत हह कक उनकत आपसन सनबनध बतहतर हह तथन आगत भन वत सनतह पपवरक पकत- पतनन कत रप मम एक सनथ रहमगत तथन वववनकहक जनवन कत दनकयतवव कन कनवनरहन करमगत। ख. यह कक मकहममद अहमद @ ममननम ( यनकचकनतनर सन० 3-पकत) आशसत करतत हह कक वह अपनन पतनन- शनमतन शनबन कम रवशन ( पकतवनकदनन सन०-3) कन पपरन धयनन रखमगत तथन उनकत खननत- पननत एवन उनकक और सभन जररतव और आवशयकतनओन कक पपरर करमगम। ग. यह कक शनमतन शनबन कम रवशन ( पकतवनकदनन सन० 3- पतनन) नत भन यह सवनकनर ककयन हव कक वह अपनत ससमरनल मम अपनत पतनन धमर कन पनलन करमगन तथन अपनत पकत- मकहममद अहमद @ ममननम ( यनकचकनतनर सन०-3) कन पपरन धयनन रखमगन। घ. यह कक दकनव पककनरव कत पररवनरजन/सगत-सनबनधन, दकनव कत शनसनतपपरर वववनकहक जनवन मम अननवशयक हसतकतप नहह करमगम इस बनत कक समकनकशच करनत कत ललए दकनव पक इस बनत कन धयनन रखमगम। ड. यह कक दकनव पकव नत एक दपसरत कत लखलनफ लजतनत भन ममकदमम दनयर ककयत हह, वत उन सभन ममकदमव कक वनपस/ समनप करन लतगम। च. यह कक दकनव पक एक दपसरत कत लखलनफ, इस वववनकहक वनद कत सननदभर मम ककई नयन वनद दनलखल नहह करमगम। छ. यह कक दकनव पकव कत बनच यह भन सहमकत हहई हव कक यकद ककई भन पक उपरकक समझझतत मम कहन गई बनतव/ शतरन कन उलनघन करतगन तक दपसरत पक कक कननपनन पककयन अपनननत कक पपरर सवतनततन रहतगन।" 7. In view of the above, the writ petition is allowed. Consequently, impugned First Information Report dated 22.6.2023, registered as Case Crime No. 0148 of 2023, under Sections 313, 354, 354Kha, 376, 504, 506, 120B, 328, 201, 34 IPC and Section 67 IT Act and Section 3/4 Muslim Women (Protection of Rights on Marriage) Act 2019, P.S.
