Present applicant Gurpreet Singh @ Gopi is praying for anticipatory bail in relation to FIR dated 21.05.2025, bearing FIR No. 0238 of 2025 registered at P.S. Rudrapur, District Udham Singh Nagar wherein present applicant along with one unknown person were implicated for the offences punishable under Sections 109, 351 (2), 352 of the BNS 2023. 4. It is submitted by the learned counsel for the applicant that the main role has been assigned to other accused, who is not named in the FIR. He further submits that applicant is innocent and has been falsely implicated 5. On the other side, Mr. Tumul K Nailwal, learned AGA for the State has placed before this written instructions and as per written instructions, entire incident was recorded in the CCTV wherein applicant has been found to be present at the time of incident. Apart from this, he submits that other co accused has already been arrested on 23.05.2025 on whose pointing out one Tamancha of 315 Bore and 3 live cartridges were recovered and as per, written instructions, applicant is still absconding. 6. After hearing learned counsel for the parties and further taking into consideration, the written instructions placed before this Court by the learned AGA in which it is clearly mentioned that applicant is still absconding and other co-accused has already been arrested, this Court is of the view that applicant does not deserve for anticipatory bail. 7.
