JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2025:KHC:33646 WP No. 8803 of 2025 ORAL ORDER The petitioner's son is sentenced to undergo imprisonment for offences punishable under Sections 376AB and 506 of the Indian Penal Code, 1860 [for short, 'the IPC'] in SC No.168/2019 and he is sentenced to undergo imprisonment for 20 years. The petitioner's son is in prison for more than six years. The petitioner seeks general parole for his son because of his heath reasons relying upon the Discharge Summary and other medical reports issued by M/s Jayadeva Institute of Cardio Vascular Sciences and Research. The Discharge Summary shows that the petitioner has a heart condition. The Imprisonment Certificate which is one of the annexures to the petition indicates that the convict's conduct in jail is satisfactory. When queried, Ms. K.P. Yashoda, learned Additional Government Advocate, who is called upon to accept - 4 - HC-KAR NC: 2025:KHC:33646 WP No. 8803 of 2025 and secure report, submitted that she is yet to receive the report, but she does not point out any contra conditions for grant of general parole. Therefore, the following ORDER [A] The petition is allowed. [B] The second respondent is directed to grant General Parole to the petitioner's son subject to the terms as contemplated under the Karnataka Prisons and Correctional Services Manual 2021 on receipt of certified copy of this order.
