THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY This Criminal Petition, under Sections 480 and 483 of the Bharat-lya Nagarik SurakSha Sanh'lta, 2023, has been filed by the Petitioner/A16, seek'lng ba" in crime No.79/2024 of Macherla Town police Stat'lOn, palnadu District. 2. A case has been registered aga-InSt the Petitioner and Others for the offences pun-lshable under sections 324 and 506 read with 34 lPC. 3. Case Of the Prosecution, in brief, iSthatOn 13.5.2024 at 1.30 pm, the informant, along with some other TDP party leaders, Was Present at back s'lde of polling booth in view of General EIections, at that time Al to A5 along w-lth others who are ysRCP party leaders Came tO him in Scorpio vehicle bearing registrat'lon no.AP 39 NL 4959, abused them -ln filthy language and attacked them with deadly weapons i.e. sticks, kn-lves and axes. when the informant interfered, Al and A2 tried to Stab h'lm. Then informant raised hue and cry, then the persons present there intervened. on 14.5.2024, the 'InfOrmant gave Statement tO POliCe. Basing on the same, police registered the above said crime and investigated into. During the course of investigation, pol'lce arrested the petitioner on 24.01.2025 and got remanded him to judicial custody. 4. Heard. PerusedthereCOrd. 5.

A perusal Of the material aVa-llable On record goes tO Show that basing on the confessional statement of the co-accused, name of the petitioner has been shown as an accused 'ln this crime. ln pursuance of the confessional statement, it is alleged that along with other accused, the petitioner was present at the tlme of the incident. Except the Sa|ld averment, there is no other mater'lal available on record tO COnneCt the petitioner with the crime. Learned COunSel for the Pet'ltiOner Submitted that the petitioner was remanded to judicial custody on execution of pT warrant on 24.01.2025. For the last 35 days, the Petitioner has been languishing in judicial remand. 7. ln View Of the aforesaid facts ar`d Circumstances Of the Case, this couit is inclined to grant ba" to the petitioner herein, on the following conditions. (i) The petitioner/A16 sha" be released On his executing a Personal bond for Rs.10,000/-(Rupees ten thousand Only) With two Sureties for a like sum each to the satisfaction of the learned Addit'lOnal Junior civil Judge, Macherla®, (ii) After release, the Petitioner Sha" appear before the Station House officer concerned once in a week i.e. on every sunday in between 10.00am and 5.00pm till filing Of Charge Sheet.
