JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 2 07-02-2025 Heard learned Counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest for the offences alleged under Sections 30(a) of the Bihar Prohibition and Excise Act, 2022 registered in connection with Belaganj P.S. Case No. 451 of 2024. 3. Allegedly, the petitioners have been booked for Bihar Prohibition and Excise Act for recovery of total 190 litres of country made liquor contained in six gallons along with five Patna High Court CR. MISC. No.82606 of 2024(2) dt.07-02-2025 2/2 gas cylinders from the bank of river falgu. 4. Section 76(2) of the Bihar Prohibition and Excise Act, 2016 makes an explicit embargo on entertaining the application under Section 438 of the Cr.P.C. 5. Since the provision of Section 438 of the Cr.P.C. is not applicable in respect of offences under the Bihar Prohibition and Excise Act, 2016, as such, this anticipatory bail application is dismissed as not maintainable.
