ORAL JUDGMENT

Heard the learned counsel for the appellants as well as the learned counsel for the respondents.
2. It is submitted by the learned counsel appearing for the appellants that compassionate appointment was denied to the writ petitioner on the ground that her husband was a Probationary Mazdoor and would not come under the definition of 'employee'.
3. The learned counsel appearing for the respondents would on other hand contend that compassionate appointments had been directed to be granted by this Court to dependents of Probationary Mazdoors in several other cases which have been referred to the judgment of the learned Single Judge. It is submitted that in all those cases, the employments have been granted by the appellants as well.
4. In the above view of the matter, we are of the opinion that we do not have go into any of the further questions raised in the appeal. In view of the fact that the directions issued by

the learned Single Judge in identical matters have been complied with, we are of the opinion that there is no merit in this writ appeal. The writ appeal therefore fails, the same is accordingly dismissed.
