JUSTICE RAJESH RAI K ORAL JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) Heard the learned counsel for the appellant. 2. This appeal is preferred by the Chief Officer, Pandavapura Pattana Panchayath against the judgment and award dated 27.11.2020 passed by the Senior Civil Judge and JMFC, Pandavapura in LAC No.3/2013. 3. The only contention raised by the appellant was that the Reference Court had erred in fixing the land value for the subject land. It was further contended that the entire amount of compensation was liable to be paid by the Government. - 4 - HC-KAR NC: 2025:KHC:29841-DB MFA No. 982 of 2022 4. The matter was referred to the Lok-Adalat and the compromise was arrived at, which was approved by the Government. However, the appellant continued to raise an objection that the entire compensation has to be deposited by the Government, while the Government contended that the Government had deposited 75% of the agreed amount and that 25% of the amount had to be deposited by the appellant. 5. A memo has been filed by the learned counsel for the appellant today submitting that the balance 25% of the agreed amount will be deposited by the appellant before the Executing Court within 6 weeks time. It is further submitted that the disbursement of the amount in deposit inclusive of the amount which has already been deposited before the Executing court is subject to determination of the rights of landlord over the acquired land. 6. Having considered the contentions advanced and in view of the memo filed, this appeal stand disposed of. 7. The Executing Court shall take appropriate steps to release the compensation so deposited in accordance with the - 5 - HC-KAR NC: 2025:KHC:29841-DB MFA No. 982 of 2022 settlement after due verification of title of the private respondents. Since the matter is settled, the Registry shall refund the Court fee as applicable in accordance with law on due identification. All pending Interlocutory Application[s] shall stand dismissed.
