The petition under Section 528 Bharatiya Nagrik Suraksha Sanhita, 2023 seeks a direction to respondents to conclude investigation in complaint No. CRM/12295/2022 dated 01.02.2022 pending before respondent No.3. 2. Learned counsel for the parties have been heard. 3. On 12.08.2022, application was moved before learned JMIC, Amritsar under Section 156(3) Cr.P.C. with the prayer to direct the police to conduct investigation and submit report. On the application, learned JMIC, Amritsar called for status report from SHO concerned. The matter was adjourned a number of times. When the SHO concerned failed to file status report, this petition was filed seeking directions to the respondents to conclude investigation in the complaint. Maninder Singh, IPS, SSP, Amritsar (Rural), inquiry in the matter was conducted by Incharge, Economic Offence Wing, the matter was found to be related to monetary transactions. The case was also sub-judice, thus the parties were recommended to approach the Court for redressal of their grievance. The report was approved by the then SSP, Amritsar (Rural) and the complaint was consigned to the records. 5. Since, the police has already concluded the inquiry and consigned the complaint, learned trial Court was required to proceed further in the application under Section 156(3) Cr.P.C., in accordance with law. However, it appears from order dated 21.01.2026 placed on record by learned counsel for the petitioner, that learned JMIC has called for a fresh status report in the matter which was not necessitated. 6. Accordingly, since the police has already filed the complaint of petitioner, the petition stands disposed of with a direction to learned JMIC, Amritsar to determine the application under Section 156(3) Cr.P.C. in accordance with law, within a period of 15 days from next date of hearing in the case. 7. Pending miscellaneous applications, if any, stand disposed of.
