The applicant seeks condonation of a delay of 102 days in preferring the Second Appeal, attributing the delay to ignorance of law and paucity of financial means. The reasons so tendered, in the considered view of this Court, hardly constitute a justifiable or legally sustainable explanation. The applicant has, indubitably, failed to satisfactorily explain the delay. Nonetheless, adopting a pragmatic and justice-oriented approach, and with a view to permitting the parties to have their inter se dispute adjudicated on merits, this Court is inclined to condone the delay, particularly since the delay is of less than one year. Accordingly, the delay of 102 days stands condoned. The Civil Application is allowed to the aforesaid extent. (J. C.
