JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioners are seeking to quash the entire proceedings in C.C.No.733/2023 pending on the file of the Court of Judicial Magistrate First Class-III, at Shivamogga. 2. Petitioners are arraigned as accused Nos.2 and 3 in the charge sheet filed by Vinobanagara Police station, in their Station Crime No.236/2021, for the offence punishable under Sections 465, 467, 468 and 420 r/w 34 of IPC. 3. The case of the prosecution is that both these petitioners on the basis of forged documents created by - 3 - HC-KAR NC: 2025:KHC:50453 CRL.P No. 13350 of 2025 accused No.1, as if the petitioners were selected for the post of Assistant Traffic Inspectors, KSRTC and based on the said documents, made an attempt to get into the said job in the KSRTC, thereby committed the offences mentioned in the charge sheet. 4. It is the contention of the learned counsel that the petitioners are innocent and not involved in any crime as alleged, on the other hand, they are the victims who themselves got cheated by accused No.1. It is also contended that they are arraigned as accused without there being any sufficient material and the documents, even according to the prosecution, are allegedly forged by accused No.1 and from the petitioners no incriminating materials are seized during investigation. 5. Accused No.1 pretending to be the Officer working in KSRTC is alleged to have contacted these petitioners to provide them the job of Assistant Traffic Inspectors in KSRTC. It is no doubt, the prosecution has not alleged that these petitioners have created the documents, namely the appointment letters. However, on the basis of the said - 4 - HC-KAR NC: 2025:KHC:50453 CRL.P No. 13350 of 2025 documents, these petitioners have tried to join the KSRTC as Assistant Traffic Inspectors. 6. According to the learned counsel for the petitioners, even the petitioners are the victims from whom accused No.1 received substantial amount with a promise of providing employment in the KSRTC. However, the petitioners have to establish their defence, at the appropriate stage. 7. Petitioners are at liberty to file discharge application before the jurisdictional court and if any such application is filed, shall be disposed of in accordance with law.
