1. The present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 482 of the Code of Criminal Procedure, 1973) seeks interim bail for a period of 4 weeks in respect of proceeding emanating from FIR No. 84/2019 under Section 302 of the Indian Penal Code, 1860 at P.S. Vasant Vihar. 2. The Petitioner urges that in 2007, she had undergone a surgery to implant a rod in her right leg and she now requires a surgery for replacement of the said implant. It is further alleged that the Petitioner has a history of bronchial asthma, haemorrhoids and lower back pain and accordingly needs urgent medical intervention. 3. Although the Petitioner was being treated at Deen Dayal Upadhyay Hospital, nonetheless, counsel for Petitioner expressed dissatisfaction with the treatment being given. In this background, on 19th February, 2025, the Court directed the jail authorities to get the Applicant examined from This is a digitally signed order. concerned specialists at the All-India Institute of Medical Science1 and a report to this effect be furnished to the Court. 4. In compliance, Petitioner has been examined and the medical records to this effect have been enclosed along with medical report. The medical report dated 12th March, 2025 reads as under:

5. In light of the afore-noted medical report, Specialist at Orthopaedic department, AIIMS, after reviewing the Petitioner’s case, opined that no orthopaedic intervention is necessary at present. Moreover, since Petitioner also complained of other symptoms, the doctors of cardiology and psychiatry also examined the Petitioner and have prescribed medication. As per the report, Petitioner’s vitals are stable and she has been advised regular follow up and treatment at Deen Dayal Upadhyay Hospital/ orthopaedic department, Jail visiting orthopaedic doctors, medicine specialist, neurologist and other doctors for her complaints. 6.
In light of the opinion rendered by AIIMS, the Court finds no ground to accede to Petitioner’s request. 7. Accordingly, the present petition is disposed of with directions to the concerned jail authorities to continue to provide the Petitioner the adequate medical treatments and the prescribed medication as per jail protocols. 8.
Disposed of.
9. Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.
