ORAL ORDER
In this petition, petitioner seeks the following reliefs:
“ i) Issue a writ of Mandamus or any other order or direction to the Respondent No. to Admit/reinstate the Petitioner into Class VI, at the Respondent No.1 school for the Academic year 2025-26, as per Annexure-C;
ii) Declare the cancellation of the Admission of the Petitioner by the Respondent No.1 vide Annexure-F, is arbitrary illegal and violative of Constitution of India;
iii) Direct the Respondents to take all necessary steps to enable the Petitioner to continue his education at

Respondent No.1 School without further delay or interruption;
iv) Pass such other orders as this Court deems fit in the interest of justice and equity.”
2. Heard learned counsel for the petitioner and learned counsel for the respondents and perused the material on record.

A perusal of the material on record will indicate that the petitioner, studied Class 1 to 5 in Morarji Desai Residential School, Baraguru, Hassan District, applied for admission to first respondent – School and obtained 82.5% in the entrance examination. The petitioner applied for admission to the 1st respondent – School under Holenarasipura Block (Block 7), pursuant to which, 1st respondent issued a communication dated 11.07.2025 to the petitioner intimating him that the petitioner had been provisionally admitted into Class 6 in the 1st respondent – School. It is the grievance of the petitioner that in pursuance of the said provisional admission, petitioner obtained Transfer Certificate from his earlier School i.e., Morarji Desai Residential School and approached the 1st respondent, who cancelled the provisional admission of the petitioner by issuing the impugned communication at Annexure-F

dated 19.07.2025 cancelling the provisional admission on the ground that the petitioner was a student of Morarji Desai Residential School which was located in Holenarasipura Block but had obtained provisional admission for Hassan Block by mentioning / stating in his application that he was applying for Hassan Block which was factually incorrect, as a result of which, the provisional admission of the petitioner was cancelled. Under these circumstances, the petitioner is before this Court by way of the present petition.

Learned counsel for the respondent Nos.1 and 2 filed statement of objections as well as the memo dated 03.11.2025 enclosing a copy of details of candidates of both Holenarasipura Block (Block 7) and Hassan Block (Block 6) and submits that there is no merit in the petition and the same is liable to be dismissed since the petitioner who was entitled to get admission into Holenarasipura Block had incorrectly/erroneously applied for Hassan Block and due to oversight and inadvertence, the 1st respondent had provisionally admitted the petitioner to Hassan Block and after verification, it transpired that the petitioner was not entitled to get admitted under Hassan Block since he came under

Holenarasipura Block and accordingly, the 1st respondent cancelled the provisional admission of the petitioner, who is not entitled to any relief in the present petition, which is liable to be dismissed. 5. Before adverting to the rival contentions, it is necessary to refer to the details of the students of both Holenarasipura Block and Hassan Block, which are as under:

As rightly contended by learned counsel for the respondent Nos.1 and 2, having regard to the undisputed fact that the petitioner was earlier a student of Morarji Desai Residential School which came under Holenarasipura Block, petitioner was not

entitled to apply for admission to Hassan Block nor obtain admission to the 1st respondent – School under Hassan Block; it follows therefrom that the respondent Nos.1 and 2 were fully justified in correcting their inadvertent error in admitting the petitioner to the 1st respondent – School on the erroneous/incorrect premise/basis that he came under Hassan Block, which is factually incorrect as can be seen from the material on record, which clearly indicate that the petitioner came under Holenarasipura Block and not under Hassan Block. Under these circumstances, I am of the considered opinion that the respondent Nos.1 and 2 were fully justified in cancelling the admission of the petitioner and consequently, I do not find any merit in the present petition, which is accordingly dismissed.
