Neutral Citation No. - 2025:AHC:130893 Court No. - 4 Case :- WRIT - A No. - 10962 of 2025 Petitioner :- Intqab Husain Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Manish Kumar Kashyap,V.P. Singh Kashyap Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the parties and perused the records. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the order dated 15st July, 2025 on the ground that petitioner's wife is serving at Budaun and hence in terms of policy of State Government if one spouse is serving at particular station then other spouse should also be posted at the same station as far as possible. It is contended by learned counsel for the petitioner that petitioner has been transferred at a very distant place of 400 kms from Budaun as he has stood transferred from Budaun to Jhansi under the order impugned. He is agreed to be posted at a nearby station and submits that in this regard he is ready to make a fresh representation. Learned Standing Counsel submits that petitioner's wife is a teacher in a Government school and hence petitioner cannot claim always to be posted at Budaun or at a nearby station. In view of the above, there arises no question of granting any indulgence in the matter at this stage. However, it is provided that in the event petitioner makes a fresh representation for consideration of his posting at a nearby district in terms of the transfer policy dated 6th May, 2025 taking a plea that his wife is serving at Budaun within a period of two weeks from today before the respondent No.-2 and in the event such a representation is filed, taking sympathetic consideration in terms of the transfer police dated 6th May, 2025, his representation shall be considered and disposed of by respondent No.- 2 by means of a reasoned and speaking order, within a further period of four weeks. With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 4.8.2025 Atmesh Digitally signed by :- ATMESH KESARI High Court of Judicature at Allahabad
