Petitioner claims that fisheries right was granted in his favour, being the highest bidder and a lease deed was executed on 02.05.2025. Despite the said facts, the private respondents have encroached upon the pond and are not permitting the petitioner to operate the pond. He has already moved an application before the respondent no.2 complaining the said fact. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- Sub Divisional Magistrate, Phoolpur, Prayagraj to take action upon the respondents pursuant to the application moved by petitioner, in accordance with law, within a period of 15 days from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
