UMESH MUCHAHARY, R/O VILL. TELLSHAL, P.O. TELLSHAL, DIST. GOLAGHAT, ASSAM, PIN-785705 VERSUS THE STATE OF ASSAM AND 2 ORS. REP. BY THE COMMISSIONER AND SECRETARY TO THE GOVT. OF ASSAM FOREST DEPTT. KAMRUP (M) ASSA Advocate for the Petitioner : MR. S KATAKI, MS. R DUTTA Advocate for the Respondent : GA, ASSAM, SC, FOREST DEPTT., ASSAM BEFORE HONOURABLE MR. JUSTICE SUMAN SHYAM Page No.# 2/2 ORDER Date :26/03/2025 Heard Mr. S. Kataki, learned counsel for the writ petitioner. It appears that the petitioner in this case has assailed the letter dated 07/01/2020, by means of which the mining contract pertaining to Kurkuria Sand Mahal granted to him, was cancelled by the authorities. Mr. R.R. Gogoi, learned Standing Counsel, Forest Department, Assam, submits that after termination of the lease, the same has already been settled with a third party, who is not a party in this writ petition. Therefore, by efflux of time, nothing survives for adjudication in this writ petition. After going through the pleadings and the prayer portion, I find force in the submission of Mr. Gogoi. In view of the above, this writ petition stands closed as infructuous. JUDGE Comparing Assistant
