The only prayer made in the present petition is to direct the respondent No.2/Appellate Authority/Joint Secretary Fisheries Cooperative Society, U.P. Lucknow to consider and decide the appeal bearing Appeal No. 09 of 2025 preferred by the petitioner no. 1 under section 98 of U.P. Cooperative Society Registration Act, 1965, expeditiously. 2. Heard counsel for the parties and perused the record. 3. It appears from the perusal of the record that the aforesaid appeal was filed on 23.06.2025 which was duly entertained and, thereafter, vide order dated 25.06.2025 the next date was fixed in the matter was 18th July, 2025. 4. From the perusal of aforesaid, the Court is of the prima facie opinion that the present petition has been filed without even waiting for considerable time, immediately after filing of the appeal which was duly entertained on 25th June, 2025. 5. In this view of the matter, the Court is of the opinion that the present petition is premature petition and is liable to be dismissed. 6. At this point of time, a prayer has been made by the counsel for the petitioner to dismiss the present petition as withdrawn. 7. Prayer is allowed. 8. Accordingly, the present petition is dismissed as withdrawn. 9. It is made clear that in case the petitioner want to file fresh petition the same could be entertained at least after 30 days.
