Page No.# 2/2 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner Rajesh Timung has prayed for releasing him on bail in connection with Silapathar P.S. Case No.27/2025 under Section 285/105 of the BNS, 2023. 3. The informant has alleged that while her husband was coming home in a motorcycle, it hit an already parked Dumper. As a result of which, her husband died. Now, the informant has alleged that since the petitioner being the driver of the Dumper parked the same on the middle of the road, he is responsible for the death of her husband. 4. I have considered the submissions made by the learned counsel of both sides. 5. The petitioner has already spent 23 days in judicial custody. This Court is of the opinion that the petitioner no longer deserves to be detained in custody. His bail application is allowed. 6. It is hereby directed that the petitioner Rajesh Timung who was arrested in connection with Silapathar P.S. Case No.27/2025 under Sections 285/105 of the BNS, 2023, shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dhemaji.
