Neutral Citation No. - 2025:AHC:132784-DB Court No. - 29 Case :- WRIT - C No. - 25764 of 2025 Petitioner :- Dargah Syed Shah Sakhanu Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Shailendra Singh Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
1. Heard Shri Shailendra Singh, learned learned Counsel for the petitioner and Shri Rajiv Gupta, learned Additional Chief Standing Counsel for the State respondents.
2. The instant writ petition is preferred by the petitioner questioning the validity of
order dated 28.06.2025 passed by the Sub-Divisional Magistrate, Sadar, Budaun/respondent no.3 whereby the request of the petitioner for grant permission to hold Urs/regligious congregation has been denied.
3. Learned ACSC states that the request was made for the period 05.06.2025 to 07.06.2025, the said period has already been expired and at present no cause of action survives in this matter.
4. Considering the factual situation that since the period for which the permission was sought to hold the religious congregation has already expired, we are not inclined to entertain the instant writ petition, however, without adverting on merits, we leave it open to the petitioner to move an appropriate application before the appropriate authority, if so desires, in future seeking permission for holding mela/religious congregation and the same would be processed in accordance with law.
5. The instant writ petition is, accordingly, disposed off.
