The petitioner has been made accused in connection with Jageshwar Bihar P.S. Case No. 13 of 2022, for the offences registered under Section 395 of the I.P.C., pending in the Court of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat. On 28.05.2022 at about 8:30 p.m., 15-20 unknown persons committed dacoity in the premises of Kapoor Hard Coal Factory. It was submitted that petitioner is neither named in the F.I.R. nor he was put on T.I. Parade. It was further submitted that nothing has been recovered from possession of this petitioner. It was further submitted that co-accused Amar Kumar has been granted bail by Co-ordinate Bench of this Court vide B.A. No.9999/2022 while other co-accused persons namely Mahesh Prajapati, Abdul Samad @ Tara Khan @ Abdul Salam @ Abdul Salam Khan and Saif Ali Khan @ Dilsher Khan have been granted bail by this Court vide B.A. No.10066 of 2022. Learned A.P.P. has opposed the prayer for bail. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat, in connection with Jageshwar Bihar P.S.
