THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECTION TO THE RESPONDENT NO.3 TO RECONSIDER AND REDETERMINE THE COMPENSATION, BY AWARDING INTEREST NOT ONLY ON THE LAND BUT ALSO ON THE ERECTIONS AND IMPROVEMENTS THEREON, AS ENUMERATED AT SL.NO.2 TO 5 OF THE AWARD NOTICE DATED 01.04.2025 (ANNEXURE-E) AND TO PAY THE SAME TO THE PETITIONER EXPEDITIOUSLY, IN ACCORDANCE WITH LAW, IN TERMS OF THE REPRESENTATION DATED 18.08.2025 VIDE ANNEXURE-F.

Learned Additional Government Advocate accepts notice for the respondents.
2. Heard the learned counsel for the petitioner and learned AGA for respondent Nos.1 to 3.
3. The petitioner in this writ petition seeks a writ of mandamus directing respondent No.3 to reconsider and re-determine the compensation, by awarding interest not only on the land but also on the erections and

improvements thereon, as enumerated at Sl.No.2 to 5 of the award notice dated 01.04.2025 at Annexure-E and to pay the same to the petitioner and to consider his representation dated 18.08.2025 at Annexure-F.
4. The grievance of the petitioner is that respondent No.3 while awarding compensation, has granted interest only on the value of the land and not on the erection and improvements existing thereon. The petitioner submitted a representation dated 18.08.2025 requesting re-determination of compensation including interest on the improvement, however, the same has not been considered till date.
5. Learned AGA for the respondents submits that the petitioner’s representation would be considered in accordance with law, if reasonable time is granted.

7. In view of the above, this Court is of the considered opinion that grievance of the petitioner would

stand redressed if appropriate directions are issued to respondent No.3 to consider the representation. Accordingly, the following:
ORDER i. The writ petition is disposed of. ii. Respondent No.3 is directed to consider the representation dated 18.08.2025 at Annexure- F and pass appropriate orders within an outer limit of eight weeks from the date of receipt of the certified copy of this order in accordance with law, keeping in view Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition Act, Rehabilitation and Resettlement Act, 2013.
