Heard Mr.G.Gopinath, learned counsel for the petitioner through video conferencing along with Ms.Suji and Mr.M.M.I.Khaleel, learned Government Advocate (Crl. The learned counsel for the petitioner submits that the petitioner is aged about 70 years and he is not able to attend the Court regularly. He further submits that the orders were passed by the learned Trial Court without considering the evidence on record. He also submits that the personal appearance of the petitioner may be suspended and he may be allowed to appear through the counsel before the Trial Court. 4. Accordingly, the Criminal Miscellaneous Petition is ordered and the petitioner is permitted to appear before the Trial Court through his Advocate and his personal appearance is dispensed with at the present. 5. Mr.M.M.I.Khaleel, learned Government Advocate (Crl side) appearing for the respondent prays for four weeks time to file a counter affidavit. 6.Accordingly, four weeks time is granted to the learned Government Advocate to file a counter affidavit and thereafter, two weeks time is granted to the petitioner to file a rejoinder affidavit to the counter affidavit filed by the respondent.
