JUSTICE DR. ANSHUMAN ORAL ORDER 4 04-04-2025 Learned Counsel for the petitioner and Learned Counsel for the State are present. 2. Learned Counsel for the petitioner submits that the present Cr. Misc. has been filed for restoration of Cr. Rev. No. 1115 of 2016 which was dismissed due to non-prosecution on 20.04.2023. Counsel further submits that due to an inadvertent mistake, the petitioner could not appear on the date of the hearing. As a result, Cr. Rev. No. 1115 of 2016 was dismissed for non-prosecution. 3. Counsel further submits that notice has already been issued in this case and it has been validly served. Counsel Patna High Court CR. MISC. No.82315 of 2024(4) dt.04-04-2025 2/2 further submits that such mistake shall not take place in future. 4. Learned Counsel for the State opposes the prayer for restoration. 5. In light of the submission made above, the Cr. Rev. No. 1115 of 2016 is hereby restored to its original file, subject to the payment of Rs. 500/- (Rupees Five Hundred) by the Counsel for the petitioner to the Patna High Court Legal Service Committee. 6.
