ORAL ORDER
1. The Petitioner is before this Court seeking for the following reliefs: i.
"Issue a writ of mandamus or any other appropriate writ or order or direction to the R1 to re-issue the weapon license bearing No.130/R&P/2019 valid upto 29.07.2027 to the petitioner by quashing the order bearing No.weapon-2/S.P/25/COP/2023 dated: 10.11.2023 by cancelling the weapon license belongs to the petitioner as Annexure-K. ii. And grant such other relief/s as this Hon’ble Court deems fit to grant in the circumstances of the case, in the interest of justice and equity". 2. The Petitioner had been granted a licence to hold a NP Bore Revolver/Pistol for his self protection. In pursuance of the said licence bearing No.130/R&P/2019, the Petitioner had purchased NP Bore 32 Pistol from M/s.Indian Armour, Bengaluru. - 3 -

Subsequently, the petitioner had applied for permission to sell the said Pistol and also for cancellation of the licence which had been granted.
In pursuance of which the said license came to be granted. 3. Subsequently, the petitioner made another application for purchase of another weapon. When the same was rejected on the ground that his licence had been cancelled, pursuance of which the petitioner had submitted various representations stating that it is by mistake that the petitioner had sought for cancellation of the licence when he wanted only permission to sell the Pistol. As such, he had requested the Respondents to consider the request of the Petitioner for renewal of the licence and permission to buy a new weapon. The said representation not having been considered. Hence, the Petitioner is before this Court. - 4 -

A perusal of the documents which have been produced would indicate that the Petitioner had voluntarily sought for permission to sell the weapon, cancel the arms licence and issue cancellation orders. It is in pursuance thereof the necessary orders have been passed and the licence cancelled. Once the licence has been cancelled, the question of the Petitioner buying one more weapon without valid licence would not arise. In that view of the matter, the rejection made by the respondents cannot be faulted. 5. On enquiry with the learned AGA as to whether if the Petitioner werew to make an application for issuance of fresh licence, the same would be considered. She submits that the same would be considered in accordance with law. 6. In that view of the matter, it would be for the Petitioner to apply for the fresh licence and

thereafter seek permission to purchase a new weapon in accordance with law. 7. Reserving such liberty, the petition stands dismissed. SD/- (SURAJ GOVINDARAJ) JUDGE
