For Petitioner : Mr.T.Nixon For Respondents : Mr.S.Vinoth Kumar Government Advocate (Crl.Side) 1/6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.21433 of 2025 O R D E R This Criminal Original Petition is filed seeking direction to the respondents-Police to conduct an enquiry in FIR No.299 of 2023 pending investigation on the file of the second respondent-Police and file a final report within a stipulated time that may be fixed by this Court. 2. The petitioner is the de-facto complainant, who lodged a complaint before the respondent-Police alleging that one Mangilal, who is the employee of the petitioner's father's Pawn Broker shop, along with the other accused, had stolen certain valuable jewels and silver articles along with other accused, which have been pledged in Manapuram Asset Finance Company, with the assistance of Manapuram Asset Finance Company Staffs for getting wrongful gain. Pursuant to the said complaint, the respondent Police registered a First Information Report in Crime No. 299 of 2023 on 19.10.2023. It is further stated that in the meanwhile, the employees of the said Finance Company had filed Crl.O.P.No.25619 of 2023 before this Court and submitted that they are ready to produce the jewels before the Magistrate concerned and it be properly inventoried and he has his own apprehension to produce the 2/6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.21433 of 2025 same before the Investigating officer and the matter came to be disposed of on 09.11.2023. However, so far the respondents-Police did not take any steps to produce the jewels before the jurisdictional Court and to file a final report. Hence, the present petition. 3. Learned Government Advocate (Crl.Side) appearing for the respondents-Police, on instructions, submitted that since the stolen jewels, which were pledged by the accused in Manapuram Asset Finance Company, were not recovered, the respondents-Police are not in a position to complete the investigation and to file a final report before the jurisdictional Magistrate. 4. However, it is seen from the records that Manapuram Asset Finance Company had filed Crl.O.P.No.25619 of 2023 before this Court praying to quash the summons impugned therein, at the time of hearing, the second respondent-Police herein stated that they will take necessary steps for production of the property before the Judicial Magistrate and recording the submission made by the learned Government Advocate (Criminal Side) therein, the matter came to be disposed of on 09.11.2023. 3/6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.21433 of 2025 However, the second respondent-Police had still not taken any steps to produce the jewels before the Magistrate concerned by the Manapuram Asset Finance Company. 5. Considering the facts and circumstances of the case and also considering the submissions made by the learned counsel on either side, the second respondent-Police is hereby directed to complete the investigation and file a final report within a period of one month from the date of receipt of a copy of this order and file action taken report before this Court on or before 29.08.2025. 6. With the above directions, this Criminal Original Petition is disposed of. 7.
