Learned counsel for the petitioner contended that as per the prosecution case, 40 intoxicating tablets were allegedly recovered from the petitioner but FSL report has not been received as yet from which only, it can be determined whether it was a narcotic substance or not and whether the quantity recovered falls within the commercial quantity or non-commercial quantity. Learned counsel submitted that he may be permitted to withdraw the present petition with the liberty to approach the trial Court for grant of interim bail, till the report of FSL is received. 2. Dismissed as withdrawn with the aforesaid liberty.
