The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the the order dated 15.07.2025 passed by Civil Judge (Junior Division)/ F.T.C., Mau in Misc. Criminal Case No. 764 of 2025, whereby an application under Section 173(4) of B.N.S.S. (under Section 156(3) of Cr.P.C. has been treated as complaint case. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
